Pacific Foods of Oregon "Everyday Chef Challenge" Contest Official Rules

DATES OF PROMOTION: The Pacific Foods of Oregon "Everyday Chef Challenge" (the "Contest") begins at 12:00 p.m. Pacific Time (PT) on October 24, 2011 and ends at 12:00 p.m. Pacific Time (PT) November 14, 2011 (the "Contest Period").

ELIGIBILITY: The Contest is open to legal U.S. residents residing in any of the 50 United States and the District of Columbia, who are 18 years of age or older and have a unique, personal and valid social security number at the time of entry. Employees and their immediate family members (parents, children, siblings or spouse, regardless of where they live, or persons living in same household, whether related or not) of Pacific Foods of Oregon (the "Sponsor"), (d.b.a. Pacific® Natural Foods), and each of their respective parent companies, divisions, affiliates, contractors, subsidiaries, distributors, sales representatives, retailers, advertising and promotion agencies, and any others engaged in the development, production, execution or distribution of this Contest are not eligible. Contest is void in Puerto Rico, U.S. territories and possessions outside of the 50 United States, and where restricted or prohibited by law.

HOW TO ENTER: Visit www.everydaychefchallenge.com and complete the following required steps between October 24 and November 14, 2011 in order to receive one (1) entry into the Contest:

  1. Create an original recipe using at least one Pacific Natural Foods ingredients
  2. Submit your original recipe
  3. Complete the submission form, providing a valid email address, and click to submit (which confirms understanding of Terms & Conditions)
  4. The "Thank You" message confirms receipt of your recipe and entry in the Contest

No limit to entries per person. Entrants will receive one chance to win for every original recipe submitted during the Contest Period, with no limit to the number of entries. Entries submitted after the end of the Contest Period will not be eligible to win the Prize. In order for an online entry to be valid, entrant must have a valid e-mail address and must click the "Submit" button. Entrants must complete the entire recipe submission process in order to be entered into the contest. If the registration process is aborted before it is complete entrants are not be eligible to win. Any attempt by any entrant to plagiarize a previously existing recipe will void that entry and that entrant may be disqualified from the Contest. In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed submitted by the person in whose name the e-mail account is registered. Entries and recipes will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses, or the domain associated with the submitted e-mail address. Potential winners may be required to show proof of being the authorized account holder.

WINNING & NOTIFICATION: At the conclusion of the Contest Period, one (1) winner will be named in each of the four (4) categories by the judges, and one (1) People's Choice winner will be chosen by popular vote. During the campaign period, one (1) winner will be chosen each day as Pacific's Everyday Pick. The winners will be notified by email. For the People's Choice Prize, the recipe with the most number of votes will be the winner and the second and third most popular recipes will be held as alternates in the event that the winners do not claim his or her Prize within five (5) days of Sponsor's notification.

PRIZE: Twenty-nine (29) Prizes total will be awarded to the winners: twenty-two (22) Everyday Picks Prizes, four (4) category prizes and three (3) People’s Choice prizes. The Everyday Picks winners will be awarded a Pacifc Natural Foods Pantry Staples Kit (Approximate Retail Value $100 each), Drinks cateogry winner will be awarded a Vitamix Pro (ARV $ 450), Appetizers/Sides category winner will be awarded a KitchenAid Pro 6 qt stand mixer (ARV $300), Main Dishes category winner will be awarded a Le Creuset wide oval french oven, Le Creuset wide grill pan and Breville immersion blender (ARV $330), Desserts category winner will be awarded a KitchenAid Pro 600 Stand Mixer and Ice Cream Bowl Attachment (ARV $480), the People’s Choice first place winner will be awarded a Le Cruset 11-piece set (ARV $1000) the People’s Choice second place winner will be awarded a $500 gift card to Williams-Sonoma and the People’s Choice third place winner will be awarded a $250 gift card to Williams-Sonoma.

No Prize substitutions except at Sponsor’s sole discretion or as otherwise provided herein. Sponsor reserves the right to substitute a Prize of equal or greater value if Prize becomes unavailable due to reasons beyond the control of the Sponsor. Prize is not transferable prior to award. The value of Prize may be taxable as income and Winners are solely responsible for any taxes on the Prize, including, but not limited to all applicable federal, state and local taxes if applicable. No more than the number of prizes set forth in these Official Rules will be awarded (29).

PRIZE CLAIM & REDEMPTION: The potential Prize Winners will be contacted via email and must respond to the Sponsor by email or phone within five (5) business days of Sponsors' notification, or will be subject to disqualification. If a Potential Winner fails to respond within stated time period, that Potential Winner will be disqualified and an alternate winner will be selected. The Prize must be redeemed within 1 year of notification. Failure to redeem the Prize within this time frame will result in a withdrawal of the prize.

GENERAL RULES OF PARTICIPATION: By participating in this Contest, entrants and winners release each and all of the Contest Entities, from any and all liability, damages or causes of action (however named or described) with respect to or arising out of participation in the Contest, and/or the receipt or use/misuse of the Prize awarded, including, without limitation, liability for personal injury, death or property damage. By participating in this Contest, entrants agree to be bound by these Official Rules. Sponsor reserves the right permanently, to disqualify from this Contest, any entrant it believes have violated these Official Rules. All federal, state and local laws apply. In the event any portion of this Contest is compromised by activities beyond the control of the Sponsor which, in the sole opinion of the Sponsor, corrupts or impairs the administration, security, fairness or proper play of this Contest, Sponsor reserves the right at its sole discretion to modify, suspend or terminate the Contest. Entering the Contest by submitting on www.everydaychefchallenge.com constitutes permission for Sponsor and its agencies to use participants' names (first name and last initial) for purposes of advertising, promotion, publicity, consumer newsletters and social media channels (Facebook and Twitter) without compensation, unless prohibited by law. Entries to the Contest in the form of submitted emails become the property of Pacific Foods of Oregon and, should the company choose to use this content for promotional purposes, entrant is not entitled to compensation or credit.

Sponsor and/or Contest Entities are not responsible for lost, late, misdirected, undeliverable or incomplete entries, whether due to system errors or failures, faulty transmissions or other telecommunications malfunctions, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise. Sponsor may prohibit an entrant from participating in the Contest or winning a Prize if, in its sole discretion, determines that said entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other entrants, Sponsor, or Contest Entities. If for any reason this Contest is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest and select winners from those entries received up to the cancellation/suspension date.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

NO LIABILITY: By participating, entrants agree to release, discharge, indemnify and hold harmless the Sponsor and Contest Entities and each of their respective officers, directors, employees, representatives and agents from and against any claims made by winners, entrants, or any other third parties, related in any way to the operation of this Contest as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any Prize or participation in any Contest-related activity or participation in this Contest.
